The High Court today (Wednesday July 24th, 2024) issued its judgment in the case being taken by An Taisce for a Judicial Review of the Government’s fifth Nitrates Action Programme (NAP). In that judgment, it has decided that it will be referring questions on the detail of the case to the European Court for consideration. The exact questions will be published in a later judgment. 

In today’s judgment, the Court has recognised that An Taisce raised novel, complex and important issues of EU law, and we welcome the prospect of clarification from the EU courts that this referral will deliver.
